These Terms and Conditions ("Terms") constitute a legally binding agreement between you and BoostPanel ("BoostPanel", "we", "us"). By registering, accessing or engaging our Services you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old and capable of entering into a legally binding contract under Indian law to engage BoostPanel.
2. Account
- You must provide accurate, current and complete information during registration.
- You are responsible for all activity that occurs under your account and for keeping your password confidential.
- One person or business may hold only one account. Multi-accounting to abuse promotions or referrals is prohibited.
3. Services
BoostPanel is a digital marketing agency providing services such as social media strategy, content planning, campaign management, paid promotion (Meta Ads, Google Ads and similar), analytics and reporting. The exact scope, deliverables and timeline are agreed with each client in a written proposal or dashboard order before work begins.
4. Payments
- All fees are payable in advance through the payment methods offered on our website.
- Any prepaid balance in your client dashboard is used to settle agreed invoices and campaign spend. Balance is non-transferable and has no monetary value outside the Services.
- Prices are in Indian Rupees (INR) and are exclusive of GST unless stated otherwise.
- You must submit correct reference numbers for offline / UPI payments. Duplicate or false references will be rejected and may lead to account suspension.
5. Acceptable use
You agree NOT to use the Services to:
- Promote accounts, pages, videos or content that you do not own or lack authorisation to promote.
- Promote private, protected, restricted, adult, hateful, defamatory or illegal content.
- Violate the terms of any social media or advertising platform, or any applicable law, rule or regulation.
- Attempt to reverse-engineer, scrape, or overload our systems or client dashboard.
- Initiate a chargeback, dispute or reversal against a validated payment — such actions will lead to permanent ban and may result in legal action.
6. Delivery of services
- Work begins within the timeline stated in your proposal or on the relevant service card in the dashboard.
- Results such as reach, engagement and conversions depend on many external factors and are provided as estimates, not guarantees.
- If a specific deliverable cannot be provided due to platform policies or third-party outages, we will use reasonable efforts to reschedule or offer an equivalent alternative.
7. Refunds & cancellations
Refunds and cancellations are governed by our Refund & Cancellation Policy.
8. Intellectual property
All content, branding, code and design of BoostPanel are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify or redistribute without written permission. Creative work produced for you is licensed to you for use in the campaigns for which it was created.
9. Third-party services
The Services depend on third-party advertising platforms, hosting and payment processors. We are not liable for their acts, omissions, downtime or price changes, but we will use reasonable efforts to reroute or reschedule your work where possible.
10. Limitation of liability
To the maximum extent permitted by law, BoostPanel's aggregate liability for any claim arising out of or related to the Services will not exceed the amount you paid us in the 30 days preceding the event giving rise to the claim. We shall not be liable for indirect, incidental, consequential or special damages, including loss of profit, data, goodwill or account suspension by third-party platforms.
11. Indemnity
You agree to indemnify and hold harmless BoostPanel, its officers, employees and partners against any claims arising from your misuse of the Services or violation of these Terms.
12. Suspension & termination
We may suspend or terminate your account at our discretion, with or without notice, for violation of these Terms or suspected fraud. Balance obtained through fraud, chargeback or bonus abuse will be forfeited.
13. Changes
We may modify these Terms at any time. Continued use after posting constitutes acceptance of the updated Terms.
14. Governing law & jurisdiction
These Terms are governed by the laws of India. The courts of Pune, Maharashtra, India shall have exclusive jurisdiction over any dispute.
